1 st problem is easy to fix, when i checked the US site for current fee rates it clearly said money order should be addressed to U.S. dept of state, so that is what i did. The dude in iowa thinks it should have been payable to his office. Getting a new money order is no big deal, but i would like to include something that says yes this is in fact the correct office to process my DS-11...do your job.

I'm wondering why this was sent to the Secretary of State for Iowa. Passport applications are handled by the Federal Government State Department and the DS-11 is a Federal form not a Iowa State form. Maybe this is a good question to answer first before going an further.
6 When you sign the first page, write "Without Prejudice" above your name. Some people also add UCC-308, but I prefer to remain in common law when signing my contracts. Also, circle or underline the words non-citizen national in the declaration just above the signature line. (The instructions state to wait until the applicant is in front of an agent to sign the documents. Disregard these instructions, as your application will be mailed to the Secretary of State in the state in which you were born.)
However I admit I don not know why, There are some in depth documents on procedure i have that came with the Marshal pack, i was going to dig in that stuff tonight to see if i can find the reason, i am sure there is one i just don't know what it is.
I will certainly post anything i find, my current plan is to just get a new money order and try again, worst that can happen is he sends it back again...which will be much harder for him to do with his office named as payee.

I pulled up the application form for the DS-11 and lo-and-behold there are multiple statements suggesting that a SSN is "required" to be used in the application and that failure to enter one may result in denial and possibly a fine enforced by the IRS. Here are the items I found:
FAILURE TO PROVIDE INFORMATION REQUESTED ON THIS FORM, INCLUDING YOUR SOCIAL SECURITY NUMBER, MAY RESULT IN SIGNIFICANT PROCESSING DELAYS AND/OR THE DENIAL OF YOUR APPLICATION.
1 - FEDERAL TAX LAW
Section 6039E of the Internal Revenue Code (26 U.S.C. 6039E) and 22 U.S.C 2714a(f) require you to provide your Social Security number (SSN), if you have one, when you apply for or renew a U.S. passport. If you have never been issued a SSN, you must enter zeros in box #5 of this form. If you are residing abroad, you must also provide the name of the foreign country in which you are residing. The U.S. Department of State must provide your SSN and foreign residence information to the U.S. Department of the Treasury. ....just wondering about the potential issues with these application statements. I know that Judge Hamilton no longer is a taxpayer but many of us still are and there may be issues with sending in an application with deliberately wrong SSN of 000-00-0000. Anyone want to chime in on this?
If you have not seen a drivers license application in awhile take a look at your states, they are all over this stuff, at least Nebraska is.

The question I have is how can you say it "may" and it "must" in the same breath...sounds like double speak to me.

It is my understanding that a living man, free inhabitant, people of the state, non resident alien individual isnt subject to the codes and statues of the irs? having said that i have received a letter asking for the ssn after i had already sent a letter with the app stating plainly that no ssn would be given, and sent another letter telling them again that no ssn would be given, and wanted the name and contact of the one demanding it, i havent gotten a response from that letter.
I don't see how any state national can use this form. In the perjury statement it says: "I am a citizen or a non-citizen national of the United States...." To me, it wouldn't matter if we hilited the non-citizen national part, we would have to cross out the words United States or we would be a citizen thereof. Am I wrong here? They have it so that a state national can't travel.
I am interested in getting the passport as it has been spoken about on here, however I do have a question or two. I was not born in the USA, I was born in Angola Africa and became a Naturalized Citizen. Does this apply to me too? the DS 11 is asking for my place of birth and the place of birth of my parents - what I put on there, where they were actually born? or the state in which they and I live? Also do I have to fill out the part if I have been married? I am no longer married and don't wish to put her information on there unless I have to.
And regarding the not putting soc sec has it worked for anyone recently? also does anyone have a sample explanatory statement that has been successful in getting the passport that would be so kind to share?

I am not sure how to handle that. I do know that the way the 14th amendment is written, not everyone who is born or naturalized in the "United States" is subject to the jurisdiction thereof. But the SoC has been fighting letting anyone out ofthe system for some time.
I took the course. The attorney has 35 years of litigation experience. He gets into a great deal of detail about how to beat the opponent. He does not agree with challenging court jurisdiction not does he think we still have common law. But it is on procedure that we usually lose. So when one gets a firm grasp on procedure, then he can't lose.
If someone has a firm grasp of procedure and the case law that attorney's to not ever use because they will ot use anything older than 1939, then they would have to rebut any such case law that still stands today.
So this guy has a blog, not bad info there. But this guy is saying that they way we are being shown to fill out the passport paper work is falsifying a federal document, this could carry a 10 year stinnt from what I am finding.
Now as I don't take every ones word based on just what they say.

The whole point here is that you are applying for a Passport as a US National (non-US citizen) and their statutes don't apply to you. The state Department is obligated to provide this service to ALL Americans whether or not they are US citizens or US Nationals. If they choose to use forms that attempt to coerce us to enter the jurisdiction of a US citizen then we act like a people and modify the form so that it correctly identifies us. This is how a sovereign behaves and asserts his sovereignty over those who are in his/her/their service. Obviously they will attempt to assert otherwise but remember that •No officer can acquire jurisdiction by deciding he has it. The officer, whether judicial or ministerial, decides at his own peril."
After 5 months dealing with the State Department I finally received my Passport.
Since I am no longer a US Citizen and I work and live overseas, I would like to know if I have to submit a FBAR and FATCA report.. I will not file a Tax return this year.. My concerns is the FATCA and Fbar reporting...\\Thank you
I realize this comment is old, but I missed out on some comments back then. I have two friends in Georgia who got their passport and stated that they were not US citizens or did not provide an SSN. The result was, they got a passport
Just to make sure everything did what was expected, one of them went to the SS Administration with an SS-5 to update his status. He filled it out to correct his citizenship status. The SS-5 can be used to apply for a SSN, a replacement SS Card, or correct information. Block 5 is the "Citizenship" block. One of 4 choices is "other".
So he took his form in to have the lady change his status and she look him up to say that his status had already been updated. He asked if he could see the screen to confirm. She said she could not show him the screen. (I wonder what they are hiding on that screen.) So he insisted she take the form to update his status. Two days later he got a letter informing him that he was not eligible for an SS card until his citizenship status changes.
My experience with it is I got a letter informing me that they could require the SSN if there are any taxes owed. It was a subtitle under the Income tax section. I wrote back to inform them I did not owe any such tax. As a matter of fact, I have since updated my status with the IRS to non US citizen and the notice of federal tax lien has disappeared from my credit report.

I have seen several question on this thread that I will attempt to answer.
The question about sending it to the SoC. That was instructions that we got form someone who stated that is the way to do it. However, mine was sent back to me from Michigan and another was sent back to someone in Wisconsin, so we know it does not work in those two states.
So an address in Virginia was sent to me in Virginia to send the application to for processing. Someone also told me recently that it took months to get and a lot of letters back and forth, but finally got the non-citizen national passport. Stick to your guns about he ssn. You cannot be required to submit an ssn and it is actually a felony for anyone who is requiring it.
I did mine at the passport office in person, they gave me a hard time because I didn't want to submit my SS#
I told them to submit anyway, and then a few days letter they sent me a letter asking for the SS#, after 2 letters going back and forth they finally issued my passport.
Is it best to mail in the DS-11 with your existing passport or is it best to make an appointment at the passport office? I have seen the threads about success with different offices. If it is best to mail it in, should we mail it to the state we were born in?

Any insights on what arguments that you had to use to convince them to send it anyway and reasoning that you relied upon to defned your position? What about your responses to their demand letters? This would be useful to those of us on this site as well as insightful as to what these administrators are doing.
After I submitted my Passport application along with my Explanatory statements, their request for the SS# was in violation of the privacy act, and there request for the SS# citing 22 USC 271a
Revocation or denial of a passport in case of unpaid taxes was a misapplication of authority because this pertains to certain causes of unpaid taxes,, and I ask them to show evidence that I owe any taxes..
After I sent letter they sent the same letter without any explanation of the letter I sent to them..
Again asking for the SS#.
Then I wrote back in a explanatory statement, In my statement I wrote Social Security administration Number for Kevin…..
Again listing they were in violation of the 1974 Privacy act, Citation of 22 USC 2714a with no evidence. The passport office has my number from previous passports. And the SS # does not belong to me but to the federal government.
The number is provided in my explanation statement under duress, no contract is being formed.
I am not a US 14 amendment citizen and the SS # shall not indicate such.
I am a citizen of my state, I am not residing in the US conducting Trade or Business within The US defined by 26 USC 7701

I hope this helps, even when I tried to do this in the embassy, I was told I must submit the SS or they will not process.. I told them its in violation and he told me he did not care… Then I flew to the USA and met up with Christopher in Boston and the process began… Now they did make some changes about the reason why they want the SS# but after dealing with them for 5 months Christopher with his letters prevailed.
I am happy to hear you got it without the ssn. They do not like to issue without the ssn, because they have to remove the applicants from their system. I heard recently from someone in Wisconsin who got hers and her "address" can not longer be found. Interesting. She has lived in the same place for 18 years.
I have yet to hear from anyone directly who has had success in getting this done through the SOC of the state in which he was born. I think I am going ot update the instructions page to simply follow that on coppermoonshinestills.com. I like the mail in option myself. I am going to do it that way and include a letter up front instructing that the requirement of the ssn is a felony and include the federal statute that makes it such. It might save some time.
I am reading the moonshinestill site that has been referenced on this site as one to follow, he states: Your social security number is voluntary. But again, do put it on the passport application or you will be denied. Use all zeros for the social security number or leave it blank, if you wish to not use it. so my question is does it matter whether you use it or not, and if it does matter then why does he say add it?
I did not use mine. I have not heard back yet. I do know several people who have not used it and have gotten their passports. One of them went to the social security administration afterwards to update his ss-5. He was told there was nothing for him to update. He insisted the form be submitted anyway, because the clerk told him she could not print out what she was seeing. He received a letter a couple of days later stating that he could not be issued a social security card until he updates his citizenship status. This serves as evidence he is not listed as a non-citizen national.
I have been saying people should mail it in. Dieseldoc, that is a good idea, filling out the affidavit in front of the agent who is insisting on the ssn.
I just returned from the Passport Agency. They eventually accepted my passport application. I was prepared with a pre-notorized "complaining victim of felony" but it wasnt needed. Items I had with me were the properly filled out application with "In care of" for the mailing address and "non-domciled" in the permanent address along with everything checked as NO to US Citizen. I also included a modified 5 page version of USA passport attachment from SEDM.ORG. I also had a copy of a pre-filled out SS-521 form (terminating my SS-5 application) just in case. This is something I've been needing to do for a while and this would be a good time to start.
It was a 2 step process. There is a gatekeeper (pre-checks all documents) and the actual passport agent. The gatekeeper asked why I was submitting a DS-11 since I already has an existing passport. I explained that some of the information on the current passport was incorrect and I needed to submit the form to correct the information. She asked what was incorrect and I stated it was my citizenship. She then asked a list of questions like where was I born etc etc. I told her that I was not a US Citizen and she should read the USA attachment if she needed more info. She asked about the SSN and stated she could not provide a number to stand in the next line without it. I then gave her the SS-521 form and stated I was in process of terminating that application and that I could not provide one. She then gave me a number to wait in line.
The actual passport agent asked similar questions and then looked at the attachment and stated she needed to speak with someone. She was gone for at least 20 minutes. When she returned, all she said was that I'd probably get a letter in the mail stating that a SSN number is required and that this would delay the process and I probably wouldnt get a passport prior to my travel date. (the only way to get an appointment is to have physical proof of international travel within 2 weeks).
She took my money and gave me a receipt.
That is my experience from today. Will keep everyone posted on what happens next.

I have the application filled out as per the instructions from the copper site and in the SS section I put N/A per 42 USC 408 a-8 and I think this should work.

The info to send the DS-11 to the state soc was not correct. The US Department of State is responsible for issuing passports to both classes of people, US citizens AND non-citizen nationals as indicated in the signature block of the DS-11.
I mailed mine in with the old passport and included the attached cover letter. I did get a letter back, but it was to have the payee on my check corrected from Dept. of State to U.S. Department of State. That was the only problem they had with my package. Read the attached letter i mailed in with my app for an idea of what i told them up front to prevent delays.
on the passport app, where it ask for information about a former spouse, and this is no joke, what if you dont have the information it calls for or cant remember, honestly the only thing i can remember about my last spouse was her name , no dates married, divorced, nothing, and i have no records, its been too long, how is that best addressed, i want to do the passport now, but im stumped here, thanks for any help it is greatly appreciated.
They are collecting information on you and they usually only get information about you from you. I do not believe it is a crime to forget you had a former spouse. What really is the significance?
As a matter of fact I had a girlfriend back in the 80s that I lived with for a couple of years and was engage to marry, and I honestly forgot her last name.
Why do I keep hearing that they are enforcing the social number?
I keep hearing from people that the State Department is enforcing the social security number regardless of whether or not one wants to give it, otherwise no passport is being issued.

they denied my application because i refused to give the ssn, I ask for laws requiring I disclose a sssn, a law requiring that I am required to be a us citizen, and the law that requires me to have a zip code, as well as if they are under a bond, this wasnt the first time i ask questions no responses, and i gather by them sending computer generated letters with no name they can get away with it. They returned the old passport i returned but denied the app and kept the postal money signed reserving my rights. the money order hasnt been cashed in three months. Im trying to figure out my options now.

Long before I knew much about this subject, only that a SSN was NOT required, I helped my daughter fill out a passport application and instructed her to write "None - religious objector" where they asked for the SSN. She received her passport without issue.
Can you share what year? I understand the SSN requirement has become more rigid in the last few years. People were able to use all zeros or leave blank, previously. Wonder if the "None- religious objector" entry will suffice currently. Thanks for sharing.
I just resent mine for the expedited service to the Philly address. I used a similar cover letter to Mr. Hamilton's and also added a statement about it being against my religion. Hopefully I"ll find out in 5-10 days how that works out.

It seems I got a canned answer ("Are you sure you don't want to be a sheeple?"), requesting that I re-submit an application, complete with form DS-11, ID, photo, the letter, and $25 execution fee to an acceptance facility. They complain that I must "provide evidence of U.S. citizenship" and there is blah blah blah about obtaining records from a vital statistics office. And then it goes on to "IN ADDITION, we have reviewed the identification that was presented with your application. Your Social Security Number was not provided on your passport application. Please provide your Social Security Number by clearly writing it in the spaces provided below. [blank area on letter] If you have never been issued a Social Security Number, please submit a signed statement under penalty of perjury to that effect or use the following....". I used all zeroes on my application.
I intend to compose a letter stomping out all their requests as follows. I am going to remind them that I am not a U.S. Citizen as I stated in my original cover letter, and the non-citizen national part that was noted on my DS-11 form. Thus requesting evidence of such is absurd. And then, with the SSN, my case is special; my parents got me one as a baby and then realized the mistake later- my father sent paperwork to all the right places and in the right formats to protest the fraud of it all to get it cancelled when I was only 5 years old. (Of course the SSA claimed they never delete records completely because they don't want to issue a number more than once). So I am going to reply that I have never volunteered to have a Social Security Number and still do not wish to do so. I am certainly not going to swear anything under penalty of perjury.
My remaining question is what I should do about the applying in person in front of an "authorized Passport Acceptance Agent, as required by law"? I was thinking of pointing out that there is no new information being submitted anyway. What law are these geniousses referring to? All I've been able to find is the reference to how the execution of DS-11 is usually performed. 51.21 Execution of passport application. and 51.22 Passport agents and passport acceptance agents .
I took mine to the municipal building here in the town I live in, there is an individual there that accepts the passports, she accepted mine, took the photos and sent it, nice lady no flak at all, that is the only thing i can see that you are referring to.
They have sent me two letters I sent a response to the second one today. I asked questions requiring proof of authority and the law that compels me to give them a SSN , that requires me to use a zip code, that requires me to be a us citizen, and ask if they were under a surety bond, I spent hours trying to find out if the passport agency is under a bond, with the various state departments, the senator of my state, still no answer. I told them they had violated my civil rights, by denying me benefits because i refused to disclose a SSN, because they refused to provide me with information I ask for in regard to the name and contact information of the individuals demanding i disclose a SSN, and of having false advertising on their website. And I told them to never ask me again for a SSN , I have told them three times that none would be disclosed.
I sent my application out with a cover letter similar to Michael's along with stating that giving my SS was against my religious beliefs which it truly is. I'm at 25 days now. I did pay for expedited services as well.

....just wondering about the potential issues with these application statements. I know that Judge Hamilton no longer is a taxpayer but many of us still are and there may be issues with sending in an application with deliberately wrong SSN of 000-00-0000. Anyone want to chime in on this?

If you have not seen a drivers license application in awhile take a look at your states, they are all over this stuff, at least Nebraska is.

The question I have is how can you say it "may" and it "must" in the same breath...sounds like double speak to me.

It is my understanding that a living man, free inhabitant, people of the state, non resident alien individual isnt subject to the codes and statues of the irs? having said that i have received a letter asking for the ssn after i had already sent a letter with the app stating plainly that no ssn would be given, and sent another letter telling them again that no ssn would be given, and wanted the name and contact of the one demanding it, i havent gotten a response from that letter.

I don't see how any state national can use this form. In the perjury statement it says: "I am a citizen or a non-citizen national of the United States...." To me, it wouldn't matter if we hilited the non-citizen national part, we would have to cross out the words United States or we would be a citizen thereof. Am I wrong here? They have it so that a state national can't travel.
I circled non-citizen national on mine. That is the one they do not like to produce, because it updates the system so they will leave you alone.

I am interested in getting the passport as it has been spoken about on here, however I do have a question or two. I was not born in the USA, I was born in Angola Africa and became a Naturalized Citizen. Does this apply to me too? the DS 11 is asking for my place of birth and the place of birth of my parents - what I put on there, where they were actually born? or the state in which they and I live? Also do I have to fill out the part if I have been married? I am no longer married and don't wish to put her information on there unless I have to.
And regarding the not putting soc sec has it worked for anyone recently? also does anyone have a sample explanatory statement that has been successful in getting the passport that would be so kind to share?

I am not sure how to handle that. I do know that the way the 14th amendment is written, not everyone who is born or naturalized in the "United States" is subject to the jurisdiction thereof. But the SoC has been fighting letting anyone out ofthe system for some time.

I took the course. The attorney has 35 years of litigation experience. He gets into a great deal of detail about how to beat the opponent. He does not agree with challenging court jurisdiction not does he think we still have common law. But it is on procedure that we usually lose. So when one gets a firm grasp on procedure, then he can't lose.
If someone has a firm grasp of procedure and the case law that attorney's to not ever use because they will ot use anything older than 1939, then they would have to rebut any such case law that still stands today.
So this is the long way of saying absolutely.

So this guy has a blog, not bad info there. But this guy is saying that they way we are being shown to fill out the passport paper work is falsifying a federal document, this could carry a 10 year stinnt from what I am finding.
Now as I don't take every ones word based on just what they say.
I have found a few people and places giving the info about the passport in the manner we have here, and from copper moon shine stills, yet that guy is the first I have seen or heard that this is falseifing a federal document.
can we get some opinions on this before I do this. I really don't want to make things worse or harder to get out of the inferior courts jurisdiction.
As I am still learning most of this stuff as I am preparing to deal with title IV D issues, I want to be as armed with the truth and common law as I can be.

The whole point here is that you are applying for a Passport as a US National (non-US citizen) and their statutes don't apply to you. The state Department is obligated to provide this service to ALL Americans whether or not they are US citizens or US Nationals. If they choose to use forms that attempt to coerce us to enter the jurisdiction of a US citizen then we act like a people and modify the form so that it correctly identifies us. This is how a sovereign behaves and asserts his sovereignty over those who are in his/her/their service. Obviously they will attempt to assert otherwise but remember that •No officer can acquire jurisdiction by deciding he has it. The officer, whether judicial or ministerial, decides at his own peril."

After 5 months dealing with the State Department I finally received my Passport.
Since I am no longer a US Citizen and I work and live overseas, I would like to know if I have to submit a FBAR and FATCA report.. I will not file a Tax return this year.. My concerns is the FATCA and Fbar reporting...\\Thank you

If you still have an SSN, then you are still in their system. Just my opinion. But it seems like the SSN is the key to everything they do to us.
I realize this comment is old, but I missed out on some comments back then. I have two friends in Georgia who got their passport and stated that they were not US citizens or did not provide an SSN. The result was, they got a passport
Just to make sure everything did what was expected, one of them went to the SS Administration with an SS-5 to update his status. He filled it out to correct his citizenship status. The SS-5 can be used to apply for a SSN, a replacement SS Card, or correct information. Block 5 is the "Citizenship" block. One of 4 choices is "other".
So he took his form in to have the lady change his status and she look him up to say that his status had already been updated. He asked if he could see the screen to confirm. She said she could not show him the screen. (I wonder what they are hiding on that screen.) So he insisted she take the form to update his status. Two days later he got a letter informing him that he was not eligible for an SS card until his citizenship status changes.
My experience with it is I got a letter informing me that they could require the SSN if there are any taxes owed. It was a subtitle under the Income tax section. I wrote back to inform them I did not owe any such tax. As a matter of fact, I have since updated my status with the IRS to non US citizen and the notice of federal tax lien has disappeared from my credit report.

I have seen several question on this thread that I will attempt to answer.
The question about sending it to the SoC. That was instructions that we got form someone who stated that is the way to do it. However, mine was sent back to me from Michigan and another was sent back to someone in Wisconsin, so we know it does not work in those two states.
So an address in Virginia was sent to me in Virginia to send the application to for processing. Someone also told me recently that it took months to get and a lot of letters back and forth, but finally got the non-citizen national passport. Stick to your guns about he ssn. You cannot be required to submit an ssn and it is actually a felony for anyone who is requiring it.

I did mine at the passport office in person, they gave me a hard time because I didn't want to submit my SS#
I told them to submit anyway, and then a few days letter they sent me a letter asking for the SS#, after 2 letters going back and forth they finally issued my passport.

Is it best to mail in the DS-11 with your existing passport or is it best to make an appointment at the passport office? I have seen the threads about success with different offices. If it is best to mail it in, should we mail it to the state we were born in?

After I submitted my Passport application along with my Explanatory statements, their request for the SS# was in violation of the privacy act, and there request for the SS# citing 22 USC 271a
Revocation or denial of a passport in case of unpaid taxes was a misapplication of authority because this pertains to certain causes of unpaid taxes,, and I ask them to show evidence that I owe any taxes..
After I sent letter they sent the same letter without any explanation of the letter I sent to them..
Again asking for the SS#.
Then I wrote back in a explanatory statement, In my statement I wrote Social Security administration Number for Kevin…..
Again listing they were in violation of the 1974 Privacy act, Citation of 22 USC 2714a with no evidence. The passport office has my number from previous passports. And the SS # does not belong to me but to the federal government.
The number is provided in my explanation statement under duress, no contract is being formed.
I am not a US 14 amendment citizen and the SS # shall not indicate such.
I am a citizen of my state, I am not residing in the US conducting Trade or Business within The US defined by 26 USC 7701

I hope this helps, even when I tried to do this in the embassy, I was told I must submit the SS or they will not process.. I told them its in violation and he told me he did not care… Then I flew to the USA and met up with Christopher in Boston and the process began… Now they did make some changes about the reason why they want the SS# but after dealing with them for 5 months Christopher with his letters prevailed.

I am happy to hear you got it without the ssn. They do not like to issue without the ssn, because they have to remove the applicants from their system. I heard recently from someone in Wisconsin who got hers and her "address" can not longer be found. Interesting. She has lived in the same place for 18 years.
I have yet to hear from anyone directly who has had success in getting this done through the SOC of the state in which he was born. I think I am going ot update the instructions page to simply follow that on coppermoonshinestills.com. I like the mail in option myself. I am going to do it that way and include a letter up front instructing that the requirement of the ssn is a felony and include the federal statute that makes it such. It might save some time.

I am reading the moonshinestill site that has been referenced on this site as one to follow, he states: Your social security number is voluntary. But again, do put it on the passport application or you will be denied. Use all zeros for the social security number or leave it blank, if you wish to not use it. so my question is does it matter whether you use it or not, and if it does matter then why does he say add it?

I did not use mine. I have not heard back yet. I do know several people who have not used it and have gotten their passports. One of them went to the social security administration afterwards to update his ss-5. He was told there was nothing for him to update. He insisted the form be submitted anyway, because the clerk told him she could not print out what she was seeing. He received a letter a couple of days later stating that he could not be issued a social security card until he updates his citizenship status. This serves as evidence he is not listed as a non-citizen national.

produce that paper work there in office when asked for your ssn, as you need the persons name etc. start filling it out watch what happens.

I just returned from the Passport Agency. They eventually accepted my passport application. I was prepared with a pre-notorized "complaining victim of felony" but it wasnt needed. Items I had with me were the properly filled out application with "In care of" for the mailing address and "non-domciled" in the permanent address along with everything checked as NO to US Citizen. I also included a modified 5 page version of USA passport attachment from SEDM.ORG. I also had a copy of a pre-filled out SS-521 form (terminating my SS-5 application) just in case. This is something I've been needing to do for a while and this would be a good time to start.
It was a 2 step process. There is a gatekeeper (pre-checks all documents) and the actual passport agent. The gatekeeper asked why I was submitting a DS-11 since I already has an existing passport. I explained that some of the information on the current passport was incorrect and I needed to submit the form to correct the information. She asked what was incorrect and I stated it was my citizenship. She then asked a list of questions like where was I born etc etc. I told her that I was not a US Citizen and she should read the USA attachment if she needed more info. She asked about the SSN and stated she could not provide a number to stand in the next line without it. I then gave her the SS-521 form and stated I was in process of terminating that application and that I could not provide one. She then gave me a number to wait in line.
The actual passport agent asked similar questions and then looked at the attachment and stated she needed to speak with someone. She was gone for at least 20 minutes. When she returned, all she said was that I'd probably get a letter in the mail stating that a SSN number is required and that this would delay the process and I probably wouldnt get a passport prior to my travel date. (the only way to get an appointment is to have physical proof of international travel within 2 weeks).
She took my money and gave me a receipt.
That is my experience from today. Will keep everyone posted on what happens next.
Good day everyone. I was wondering if this is to be sent to the Secretary of State of the state we are from? I've seen conflicting reports, it even says to send to Dept of state in DC in the law. And I'm not sure what to do....
I have the application filled out as per the instructions from the copper site and in the SS section I put N/A per 42 USC 408 a-8 and I think this should work.
Any instructions found anywhere including this site to send the application to the state soc is incorrect.

from what I understand this is to be filed in the state you were born in.
the filing with D.C. keeps you a slave, chattel, paying taxes, generally under there thumb.

The info to send the DS-11 to the state soc was not correct. The US Department of State is responsible for issuing passports to both classes of people, US citizens AND non-citizen nationals as indicated in the signature block of the DS-11.
I mailed mine in with the old passport and included the attached cover letter. I did get a letter back, but it was to have the payee on my check corrected from Dept. of State to U.S. Department of State. That was the only problem they had with my package. Read the attached letter i mailed in with my app for an idea of what i told them up front to prevent delays.

on the passport app, where it ask for information about a former spouse, and this is no joke, what if you dont have the information it calls for or cant remember, honestly the only thing i can remember about my last spouse was her name , no dates married, divorced, nothing, and i have no records, its been too long, how is that best addressed, i want to do the passport now, but im stumped here, thanks for any help it is greatly appreciated.

They are collecting information on you and they usually only get information about you from you. I do not believe it is a crime to forget you had a former spouse. What really is the significance?

I keep hearing from people that the State Department is enforcing the social security number regardless of whether or not one wants to give it, otherwise no passport is being issued.

they denied my application because i refused to give the ssn, I ask for laws requiring I disclose a sssn, a law requiring that I am required to be a us citizen, and the law that requires me to have a zip code, as well as if they are under a bond, this wasnt the first time i ask questions no responses, and i gather by them sending computer generated letters with no name they can get away with it. They returned the old passport i returned but denied the app and kept the postal money signed reserving my rights. the money order hasnt been cashed in three months. Im trying to figure out my options now.

Long before I knew much about this subject, only that a SSN was NOT required, I helped my daughter fill out a passport application and instructed her to write "None - religious objector" where they asked for the SSN. She received her passport without issue.
Can you share what year? I understand the SSN requirement has become more rigid in the last few years. People were able to use all zeros or leave blank, previously. Wonder if the "None- religious objector" entry will suffice currently. Thanks for sharing.

I just resent mine for the expedited service to the Philly address. I used a similar cover letter to Mr. Hamilton's and also added a statement about it being against my religion. Hopefully I"ll find out in 5-10 days how that works out.

It seems I got a canned answer ("Are you sure you don't want to be a sheeple?"), requesting that I re-submit an application, complete with form DS-11, ID, photo, the letter, and $25 execution fee to an acceptance facility. They complain that I must "provide evidence of U.S. citizenship" and there is blah blah blah about obtaining records from a vital statistics office. And then it goes on to "IN ADDITION, we have reviewed the identification that was presented with your application. Your Social Security Number was not provided on your passport application. Please provide your Social Security Number by clearly writing it in the spaces provided below. [blank area on letter] If you have never been issued a Social Security Number, please submit a signed statement under penalty of perjury to that effect or use the following....". I used all zeroes on my application.
I intend to compose a letter stomping out all their requests as follows. I am going to remind them that I am not a U.S. Citizen as I stated in my original cover letter, and the non-citizen national part that was noted on my DS-11 form. Thus requesting evidence of such is absurd. And then, with the SSN, my case is special; my parents got me one as a baby and then realized the mistake later- my father sent paperwork to all the right places and in the right formats to protest the fraud of it all to get it cancelled when I was only 5 years old. (Of course the SSA claimed they never delete records completely because they don't want to issue a number more than once). So I am going to reply that I have never volunteered to have a Social Security Number and still do not wish to do so. I am certainly not going to swear anything under penalty of perjury.
My remaining question is what I should do about the applying in person in front of an "authorized Passport Acceptance Agent, as required by law"? I was thinking of pointing out that there is no new information being submitted anyway. What law are these geniousses referring to? All I've been able to find is the reference to how the execution of DS-11 is usually performed. 51.21 Execution of passport application. and 51.22 Passport agents and passport acceptance agents .
I took mine to the municipal building here in the town I live in, there is an individual there that accepts the passports, she accepted mine, took the photos and sent it, nice lady no flak at all, that is the only thing i can see that you are referring to.

They have sent me two letters I sent a response to the second one today. I asked questions requiring proof of authority and the law that compels me to give them a SSN , that requires me to use a zip code, that requires me to be a us citizen, and ask if they were under a surety bond, I spent hours trying to find out if the passport agency is under a bond, with the various state departments, the senator of my state, still no answer. I told them they had violated my civil rights, by denying me benefits because i refused to disclose a SSN, because they refused to provide me with information I ask for in regard to the name and contact information of the individuals demanding i disclose a SSN, and of having false advertising on their website. And I told them to never ask me again for a SSN , I have told them three times that none would be disclosed.

I sent my application out with a cover letter similar to Michael's along with stating that giving my SS was against my religious beliefs which it truly is. I'm at 25 days now. I did pay for expedited services as well.
